Terms of Service — Stamboom

Welcome to Stamboom (“the Service”, available at stamboom.xyz). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Stamboom is

Stamboom is a personal-use web application for viewing, exploring, and selectively sharing genealogical data that you upload from Haza-Data backup (HZB) files. It is operated by Julian de Groot as a personal project and is provided free of charge.

2. Your account

You must be at least 16 years old (or the age of digital consent in your country) to create an account. You are responsible for keeping your password confidential and for any activity under your account. We strongly recommend enabling two-factor authentication.

3. Your content

You retain all rights to the family-tree data you upload (“Your Content”). By uploading Your Content, you grant Stamboom a limited licence to store, process, and display it for the sole purpose of providing the Service to you and to the people you explicitly invite.

You confirm that you have the right to upload Your Content and that doing so does not violate any law or third-party right. Genealogical data can include information about other (living) people; you are responsible for handling their information lawfully and respectfully.

4. Acceptable use

You agree not to:

Upload content that is illegal, harmful, or violates anyone’s rights.
Attempt to access other users’ data without authorization.
Probe, scan, or test the vulnerability of the Service or evade rate limits.
Use the Service to send spam or unsolicited messages.
Reverse-engineer or scrape the Service for commercial purposes.

5. Sharing and invitations

You may invite other people to view a tree you have uploaded. By doing so you confirm that those people are entitled to see that data. Invited viewers are subject to these same Terms.

6. Availability

Stamboom is provided on a best-effort basis. We do not guarantee that the Service will be available without interruption, error-free, or that data will never be lost. Always keep your own backup copy of any HZB file you upload.

7. Termination

You can stop using the Service at any time and request account deletion by emailing julianthegroot@gmail.com. We may suspend or terminate accounts that violate these Terms, that pose a security risk, or that have been inactive for an extended period.

8. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy of data, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by applicable law, the operator of Stamboom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. The Service is free of charge; if a court finds the operator liable regardless, total liability is limited to EUR 10.

10. Governing law

These Terms are governed by Dutch law. Any dispute will be submitted to the competent courts of the Netherlands, unless mandatory consumer-protection law provides otherwise.

11. Changes to these Terms

We may update these Terms over time. The “Last updated” date at the top of this page reflects the most recent change. Material changes will be communicated to signed-in users by email when reasonably possible.
